A coding agent that rewrites its own core shipped a paper on 8 August. The interesting sentence is not the benchmark score. It is the caveat at the end.

Ouroboros is a self-developing agent harness. Its tools, prompts, context assembly and core implementation improve through reviewed commits that then become the runtime for later work. An Opus 5 run scores 86.74% on Terminal-Bench 2.1. The longest documented deployment has been running 161 days.

Now the caveat, in the authors' own words: benchmark campaigns use frozen system snapshots, while the live deployment continues evolving on a separate lineage.

Read that as a compliance sentence. The thing that was measured is not the thing that is running, and every European conformity mechanism assumes those are the same object.

Article 3(23) defines a substantial modification as a change after placing on the market "which is not foreseen or planned in the initial conformity assessment". Article 43(4) offers one escape: changes pre-determined by the provider at initial assessment and written into the technical documentation.

So the carve-out exists, and a system built around undetermined self-modification cannot reach it. Not because regulators dislike the idea. Because "pre-determined" is a document, and by construction there isn't one.

Before you relax: the high-risk obligations were deferred to 2 December 2027. What bites this morning is smaller and already live. An agent that picks its own model APIs invalidates the Annex XII documentation you obtained under Article 53(1)(b) for the model you used to run.

What I'd do Monday:

1. Write the change envelope before you ship. That document is the carve-out. Unwritten, it does not exist. 2. Make model selection an allowlist, not a capability. 3. Version the agent's core like a dependency. A commit the agent authored is a release. 4. Benchmark the lineage you ship, not the snapshot.

Self-improvement is a good engineering idea. It is also the one property that makes a system impossible to describe in the past tense, and every assurance regime we have is written in the past tense.

What in your stack changed last month without a version bump?
