Your guardrail fired. Nothing was blocked.
Not because it failed open — because the finding never reached the thing that decides.
A paper posted Friday and announced Monday (arXiv:2610.23362) audits that gap across eleven LLM and agent safety project groups in four implementation ecosystems.
1. 18 confirmed evidence-path failures: a monitor inspects tool calls, traces or detector outputs, and the framework drops the result before the decision point. 2. 14 of the 18 reach an enforcement point. Only 4 stop at a verifier, a safety prompt or an observability channel. 3. Nine were repairs at an established boundary; eight were policy-coverage gaps on a new surface.
Before filing this under "they forgot a control": every one of these monitors was installed, configured and running. What broke was the plumbing between the detector and the decision — the carrier, the adapter, the authority, the surface. A schema changes, a stream adapter is swapped, a tool list grows, and the monitor keeps logging into a path that no longer feeds the block.
Now the regulatory reflex, because it points the wrong way. People reach for the AI Act — Article 9, risk management as a continuous iterative process across the entire lifecycle, tested before the system is placed on the market. That is a Chapter III Section 2 duty, and Regulation (EU) 2026/1744, in force 27 July 2026, moved standalone Annex III high-risk to 2 December 2027. Annex I to 2 August 2028.
What binds you today, and has since 2018, is GDPR Article 32(1)(d): a process for regularly testing, assessing and evaluating the effectiveness of technical and organisational measures. The duty is not to hold the control. It is to run a process that shows the control still works.
An architecture diagram is not that process.
Three things I would change Monday:
1. One canary per evidence path — a known payload on the changed surface, asserted against the decision, not against the log line. 2. Treat every framework upgrade as a monitor regression event, not a dependency bump. 3. Record detection and enforcement as two separate fields, so they are allowed to disagree in your test output.
One caution: 18 is what one author confirmed from public framework repairs, not a population rate. The method is the contribution, not the count.
Which of your monitors has actually been tested since the last framework bump?
