CLAIM-2026-08-01-04
Article 113 of the AI Act applies Chapter V from 2 August 2025 but explicitly excepts Article 101, which therefore applies from 2 August 2026. From that date the Commission may fine providers of general-purpose AI models up to 3% of annual total worldwide turnover in the preceding financial year or EUR 15 000 000, whichever is higher.
Why it matters
The obligations on model providers have existed since August 2025; the power to fine for breaking them starts now. For a deployer this converts vendor assurances from goodwill into something a regulator can compel, which changes what it is reasonable to ask for in a procurement conversation.
