CLAIM-2026-08-03-01
Regulation (EU) 2026/1744 (Digital Omnibus on AI), adopted 8 July 2026, published in the Official Journal on 24 July 2026 and in force since 27 July 2026, refines the AI Office's exclusive competence under Article 75 of the AI Act. Recital 31 states the AI Office should have exclusive competence over AI systems built on general-purpose AI models "not only where both the system and the model are developed by the same provider, but also where they are developed by providers that form part of the same undertaking", with the personal scope extending to those providers and to their deployers within the same undertaking; other deployers remain subject to national supervision and enforcement.
Why it matters
Supervision is allocated by corporate boundary rather than by system behaviour. Two functionally identical agents built on the same model answer to different institutions depending on whether the builder is part of the model provider's undertaking — a fact an engineering team cannot read off its own architecture.
