CLAIM-2026-08-03-02

Recital 32 of Regulation (EU) 2026/1744 grants the Commission the powers of a competent market surveillance authority under the AI Act where an AI system qualifies as a very large online platform or a very large online search engine under Regulation (EU) 2022/2065, or where it is embedded in such a platform or search engine, with the first point of entry being the risk assessment, mitigation and audit obligations of Articles 34, 35 and 37 of that Regulation.

Why it matters

An agent shipped inside a designated platform is supervised through the Digital Services Act machinery before the AI Act's own. Teams integrating into large platforms inherit a different assessment entry point than teams shipping standalone.
