CLAIM-2026-08-03-03
Recital 34 of Regulation (EU) 2026/1744 provides that where national market surveillance authorities, through the single point of contact, request that the AI Office take supervisory and enforcement measures on AI systems under its exclusive supervision, the AI Office should inform the single point of contact no later than four months after receiving that request, either of its intention to exercise those powers or of its reasons for not doing so.
Why it matters
It puts a stated duration on the hand-off between a national regulator and Brussels. A complaint filed nationally against a system under AI Office competence does not disappear; it acquires a four-month referral clock.
