CLAIM-2026-08-03-04

Article 85 of the AI Act, in Chapter IX Section 4 (Remedies), provides that any natural or legal person having grounds to consider that there has been an infringement of the Regulation may submit complaints to the relevant market surveillance authority, to be handled in accordance with Regulation (EU) 2019/1020. Chapter IX is not among the derogations in Article 113, so it applies from the general date of 2 August 2026.

Why it matters

The first regulatory contact a team has is likelier to be a third-party complaint than a scheduled inspection, and the complainant may be a legal person — a competitor or an NGO — not only an affected user.
