Article 53(2) disapplies the obligations in Article 53(1)(a) and (b) for general-purpose AI models released under a free and open-source licence allowing access, usage, modification and distribution, where the parameters and information on architecture and model usage are made publicly available. The exemption does not extend to general-purpose AI models with systemic risk.

Why it matters

For a team standardised on open-weight models, the Article 89(2) channel is largely empty: there is no Article 53(1)(b) duty to enforce against the supplier unless the model carries systemic risk.
