Article 53(2) disapplies Article 53(1)(a) and (b) for models released under a free and open-source licence with publicly available parameters, architecture and usage information, and does not extend to models with systemic risk; the copyright-policy duty at 53(1)(c) and the public training-data summary at 53(1)(d) are not disapplied.

Why it matters

The open-source carve-out is narrower than the shorthand suggests: two duties lifted, two untouched, and none of it lifted for systemic-risk models.
