DORA Article 30(2)(a) requires the contractual arrangement to contain a clear and complete description of all functions and ICT services and to state whether subcontracting of an ICT service supporting a critical or important function is permitted, and under which conditions.

Why it matters

An agent supplied by an outside firm inside a platform is subcontracted ICT service. If the contract is silent, the permission question is unanswered rather than answered yes.
