CLAIM-2026-09-05-04

AI Act Article 25(1)(a): a distributor, importer, deployer or other third party is considered a provider of a high-risk AI system, subject to the Article 16 provider obligations, where 'they put their name or trademark on a high-risk AI system already placed on the market or put into service, without prejudice to contractual arrangements stipulating that the obligations are otherwise allocated'.

Why it matters

Integrating a marketplace component and shipping the result under your own name makes you the provider. No vendor inspection changes whose name is on the system.
