AI Act Article 3(49) defines a serious incident by four harm limbs: death or serious harm to health; serious and irreversible disruption of the management or operation of critical infrastructure; infringement of Union-law obligations intended to protect fundamental rights; serious harm to property or the environment.

Why it matters

It fixes what a European team is actually exposed to when an agent it operates exceeds authorised access on someone else's system, and which instrument the exposure runs through.
