Italy's D.Lgs. 9 settembre 2026, n. 160, in force since 30 September 2026, makes the omission of human-oversight measures for a high-risk AI system a criminal offence under a new Art. 437-bis of the criminal code.
Why it matters
It is the first EU member state to attach personal criminal liability to an oversight omission, and it is already in force rather than pending.
