GDPR Article 32(1)(d) requires a process for regularly testing, assessing and evaluating the effectiveness of technical and organisational measures, and Article 5(2) requires the controller to be able to demonstrate compliance. Both are in force with no deferral, and both apply only where personal data is processed.
